Millions Of Americans Count On Their Tax Refunds Each Year To Pay Down Debts

Millions of Americans count on their tax refunds each year to pay down debts, get caught up on bills, or simply to make ends meet. With an estimated 1.5 million personal bankruptcies to be filed in 2011, bankruptcy lawyers around the country are being asked the same question: “What will happen to my tax refund if I declare bankruptcy?”

Income tax refunds are basically interest-free loans to the government, and are therefore considered assets of debtors who declare bankruptcy. The trustee assigned to your case may be able to seize your income tax refund, depending upon two main factors: first, what type of bankruptcy you file, and second, whether your refund is fully  exempted.

The two main types of personal bankruptcy cases are Chapter 7 and Chapter 13. In a Chapter 7 case, debtors are essentially allowed to walk away from their debts.

In a Chapter 13 case, debtors must repay their unsecured debts over 3 to 5 years.

Most Chapter 7 cases are considered “no asset” cases, and for those assets that the debtor does possess, there are federal and state exemption laws, which prevent the bankruptcy trustee from seizing and selling the debtor’s property.

Just like the debtor’s household goods, clothing and automobile, in most Chapter 7 cases the debtor’s tax refund can be fully exempted, which means the bankruptcy trustee cannot even consider seizing the refund. However it is very important to use the full and correct exemptions to protect the refund.

Chapter 13 cases can be a bit more complicated. If you have a confirmed Chapter 13 Plan that requires repayment of only a percentage of your debt, your trustee will likely seize your refund every year over the course of your bankruptcy, using the proceeds to increase the payout to unsecured creditors.  Income tax refunds in Chapter 13 are considered “property of the estate,” so your trustee will want to apply this money toward payment of your Plan.

In 100% repayment cases, however, the trustee has no interest in seizing your tax refund.  If your income is demonstrably sufficient to satisfy your confirmed Plan, the trustee will allow you to keep your tax refund.  You may want to adjust your withholdings before filing a Chapter 13 appropriate.

The bankruptcy trustee will in most cases require the debtor to file a tax return to determine whether the debtor’s refund can be seized and used to repay creditors. Unlike a home or car with equity, which must first be auctioned to produce distributable funds, tax refunds are a quick cash windfall to the creditors.

Confused.com Launches New TV Advert

Confused.com has launched its latest advertisement featuring its animated logo Cara singing the classic hit ‘Chain Reaction’, originally penned by the Bee Gees and made famous by Diana Ross. The sixty second advert first aired on 15 February during coverage of the Brit Awards, this year hosted by James Corden.

Following the success of Cara’s first single, ‘Somebody to Love’, ‘Chain Reaction’ is once again voiced by West End star Louise Dearman. Animated and produced by Hornet, with musical arrangement from Spekulation entertainment, the advert will feature living logo Cara singing the catchy anthem before being joined by a backing group of animated singers and dancers.

The Chain Reaction song, originally recorded by Diana Ross, has been selected due to its popularity with music lovers worldwide and was a popular hit in 1985 on her album ‘Eaten Alive’. Confused.com, the UK’s leading car insurance price comparison site, has worked closely with its creative agencies on this advert to ensure it recaptures the energy of the Diana Ross original.

Northern Rock has improved its Everyday mortgage range, offering lower rates which will make it more affordable for those looking to buy a new property or remortgage their home. The new Everyday fixed rates start from just 3.09%.

Northern Rock Launches New Fixed Rate E-Bond

Northern Rock has launched a new e-bond account, providing a competitive interest rate for those savers who wish to operate their account online.

With a minimum deposit of just £1, customers can benefit from a fixed rate of interest for one year. e-bond (Issue 1) pays 3.00% gross*/AER** pa until 20 October 2011. Accounts must be opened and operated online. Initial deposits can be made online by electronic transfer from another bank or building society, or from an existing Northern Rock account.

Account holders can choose to have their interest paid annually (interest is calculated daily) on 5 August, or monthly (the monthly interest rate is 0.30% below the gross* annual rate) on the 7th of the month (available next business day).

Additional deposits can be made during the offer period up to a maximum of £250,000 per customer. e-bond (Issue 1) is non-redeemable and does not allow any withdrawals or closure during the fixed rate period. The fixed rate bond is offered on a limited issue basis and will be withdrawn without notice once fully subscribed. Once withdrawn, no further deposits will be accepted.

Barclaycard Spending Index Up 9.2% Year-On-Year in July

Barclaycard Spending Index up 9.2% year-on-year in July shows talk of Government austerity drive having little impact on consumer spending.

Consumer spending on cards saw a near double digit increase in August compared to the same month last year, challenging concerns that talk of reduced public spending is already forcing consumers to be more cautious.

According to the new figures released by Barclaycard, the amount spent on debit and credit cards, in-store and online, increased by 9.2% in August compared to the same month last year, with new autumn sales, discounts and back-to-school spending helping to keep the retail sector buoyant. The rising cost of both food and cotton may also be starting to filter through to retail prices, meaning higher spending.

This month’s increase represents the fourth month in a row that the annual growth rate has increased by more than 9%, indicating anything but a dip in confidence.

The figures challenge recent reports of a consumer spending slowdown and reduced consumer confidence, suggesting that a gap exists between what consumers say about their financial prospects and how they behave, with spending on the high street remaining strong.

Stuart Neal, head of Barclaycard UK Payment Acceptance said: “With leading retailers warning that the Government austerity drive will keep the economy in the doldrums and hit consumer confidence hard, it is good to see a fourth month of increased spending.”

“While there is some cause for viewing the near future with a certain amount of trepidation, recent indicators are good. Confidence remains relatively high, but it will be important to see how spending fares when public spending cutbacks begin to hit people’s pockets, and not just the headlines.”

M&S Money Warns Insurance Homework Should Be A Priority For Todays Students

A new survey by M&S Money* has revealed that, as thousands of students prepare to head to university, the average student bedroom contains a massive £1620 worth of gear – yet only half of students have contents insurance.

The poll found that the average student crams into their room almost £699 worth of electrical gadgets and appliances, £444 worth of clothes, sports equipment valued at £246 and textbooks worth £231.

The huge value of a student’s bedroom is not surprising, with over half of students (55%) owning a laptop, 48% possessing a MP3 player and 20% a widescreen television.

The survey also revealed that 27% of students have been burgled while at university with 71% being burgled more than once.

Despite this, only 52% of students who took part in the survey said that they have insurance to cover their possessions whilst the items are in their student accommodation.

M&S Money points out that many students heading to university will not need to buy a standalone student policy and should check if their parents’ home insurance policy provides sufficient cover.

Students whose parents have M&S Premier Home Contents insurance receive unlimited cover for their possessions while living in student accommodation. This covers events such as damage, flood or theft from halls.

The student bedroom of 2010 is very different from student bedrooms of the 80s. To mark the 25th anniversary of the launch of the financial services arm of M&S**, M&S Money surveyed students who went to university in 1985 to find out their most cherished items.

Andrew Ferguson, M&S head of General Insurance, said: “While the contents of a student’s bedroom have changed a great deal in the past 25 years, one thing remains the same – they have expensive tastes.

“Students of 2010 preparing for the new academic year may see insurance as an unnecessary expense on top of everything else. But as our survey shows the modern day student bedroom is a goldmine for thieves, so insurance could be the best investment students make this autumn.

“Many students would be surprised to know that their valuables may already be covered – they just need to check whether their parents’ home insurance policy covers their property when away from home.”
